1. Who you're contracting with
Discotheque is operated by Barking Iguana (ABN 59 728 461 877), a sole trader in Australia. By creating an account you enter into a binding agreement with Barking Iguana on the terms set out below.
2. The service
Discotheque provides online psychometric assessments (DISC, Big Five, EQ, Work Values, and others), automated scoring, and downloadable reports. Assessments are sold on a credit basis: one credit entitles you to take one assessment and generate one report. Credits never expire but are non-transferable.
3. Your account
You must provide a valid email address. You are responsible for keeping your password and TOTP device secure. You must not share your account with anyone else. You must be 16 or older to create an account.
4. Acceptable use
You agree not to: (a) use Discotheque for any unlawful purpose, (b) attempt to reverse-engineer, scrape, or bulk-download content, (c) resell access or reports without our written permission, (d) present machine-generated reports as clinical diagnoses, or (e) submit responses on behalf of another person without their informed consent.
5. Payments and refunds
Prices are shown in Australian dollars and are inclusive of any applicable taxes. Barking Iguana is not currently registered for GST; no GST is charged on purchases. Payments are processed by Stripe.
Under Australian Consumer Law you are entitled to a refund or replacement if the service is faulty or materially different from what was advertised. In addition, as a goodwill policy we will refund unused credits within 14 days of purchase on request. Credits already spent on completed assessments are non-refundable because the service has been delivered.
6. Intellectual property
The Discotheque platform, its assessment catalogue, scoring engine, and generated report templates are the intellectual property of Barking Iguana. Your individual report and responses belong to you; you may share, print, and use them freely. You may not republish our assessment questions or scoring algorithms.
7. Reports are informational, not clinical
Our assessments are based on validated psychometric instruments but Discotheque is not a medical or psychiatric service. Reports are for personal development, team discussion, and hiring support. They are not a substitute for professional diagnosis, counselling, or occupational health advice.
8. Availability
We aim to keep Discotheque available 24/7 but we do not guarantee uninterrupted access. Planned maintenance will be announced in advance where practical.
9. Privacy
Our handling of your personal information is governed by our Privacy Policy, which forms part of these terms.
10. Limitation of liability
Nothing in these terms excludes the consumer guarantees under the Australian Consumer Law. Subject to those guarantees, our total liability to you for any claim arising from or in connection with Discotheque is limited to the amount you have paid us in the 12 months preceding the claim. We are not liable for indirect or consequential loss.
11. Termination
You can close your account at any time by emailing sales@discoreports.com. We may suspend or terminate your account if you breach these terms, with notice where practical.
12. Changes to these terms
We may update these terms from time to time. Material changes will be notified by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
13. Governing law
These terms are governed by the laws of Western Australia. The parties submit to the non-exclusive jurisdiction of the courts of Western Australia and the Commonwealth of Australia.
